This petition, which is pending since the year 2010, seeks recovery of unpaid salary for the period from February, 2000 to 28th April, 2003. (for 39 months).

The petitioner, at the relevant time, was working as an Assistant Teacher in the School run by respondent No. 5. Admittedly, the Head Master of the School did not submit pay bills of the petitioner's salary for the 39 months. Such pay bills were submitted subsequently. The Deputy Director of Education decided to hold an enquiry and sent an inspection squad to the School for inspecting the record of the School and to verify whether the

wp7225.10 -2petitioner attended the duties during the disputed period. The squad submitted a report raising suspicion. Therefore, the Deputy Director of Education refused to sanction the pay bills. 3.

The question between the parties is whether the petitioner attended the duties for 39 months. Such a question appears to be beyond the scope of the writ petition. Nonetheless, the petitioner is given liberty to go to the Civil Court and take appropriate steps for recovery of the amount.

The writ petition is disposed of. No costs.
