The application seeking tribe certificate of Thakur tribe of the petitioner is rejected by the Sub Divisional Officer, Partur.

2. We have heard Mr.Phatale, learned Advocate for the petitioner and Mr. Patil, learned A.G.P. for the respondents.

It appears that the petitioner has produced validity certificate of his cousin uncle. However, the said validity was not before the authority. There is no affidavit of the validity holder stating the genealogy.

Considering the above, we set aside the order passed by the S. D.O. and remit the matter to the S.D.O. The petitioner shall produce the validity certificate along-with the affidavit of validity holder. IF the same is produced, the S.D.O. shall verify the same and pass fresh order on its own merits, expeditiously, preferably within three weeks.

Writ petition disposed of. No costs.
