ORDER :- The petitioner impugns the order dated 21.6.2024 passed by the Honourable Minister in appeal filed under Section 39 of the Maharashtra Village Panchayat Act.

Learned advocate Mr. S.B. Chaudhari submits that in pursuance of the complaint made by the petitioner the proceeding was initiated for disqualification of respondent No.4 under Section 39 of the said Act. The learned Divisional Commissioner, passed order of disqualification after hearing all concerned. Respondent No.4 preferred appeal before the Honourable Minister. Said appeal is still pending. However, vide order dated 26.6.2024, Honourable Minister granted stay to the disqualification order passed by the Divisional Commissioner. Said

{2} 958 sr.no..odt proceeding is pending till today and further date of hearing is not given. He would submit that considering the nature of litigation, the Honourable Minister could have decided appeal earlier, however, for political reasons, that has been kept pending. 3.

Having considered submissions advanced, it would not be appropriate to entertain the challenge to impugned order passed by Honourable Minister dated 26.6.2024, however, it would be appropriate for the Honourable Minister to decide the pending proceeding expeditiously and in any case within eight weeks from today. 4.

In that view of the matter, writ petition is disposed of with a request to the Honourable Minister to decide the pending appeal within a period of eight weeks from today.
