By way of present revision application, the applicant has questioned the legality and validity of the order dated 01/02/2003 passed by the Principal Judge, Family Court, Aurangabad in Petition No. E-257 of 2001 awarding maintenance of Rs.750/- per month and Rs.500/- towards the expenses in exercise of powers under Section 125 of the Code of Criminal Procedure.

The said order is assailed on the ground that the quantum of maintenance as awarded is exorbitant and without any findings, as such the income of the applicant. 3.
In my opinion, the order passed by the Principal Judge, Family Court, Aurangabad does not call for any interference in view of the considerations which were weighed before the learned Family Court while ordering the payment of maintenance. Learned Family Court has taken into account the pleadings of the respective parties and evidence of the parties in detail and source of the income of the present applicant is rightly appreciated who was working as a sales officer in the company.

In view thereof, the maintenance of Rs.750/- per month as awarded, in my opinion, does not call for any interference. As such, the revision application fails, same stands dismissed. The applicant will be at liberty to take steps as are available in law, in case he noticed certain developments in marital status of the wife. [ N.W. SAMBRE, J. ] Tupe/14.09.15
