Heard learned counsel for the applicants and learned APP for the State.

The applicants are seeking bail in Crime No.329 of 2023 registered with MIDC Police Station, District Jalgaon for the offence punishable under Section 399, 402 of the Indian Penal Code and Section 3, 4, 25 of the Arms Act.

Similarly situated co-accused have been granted bail. Hence, the applicants deserve bail. Hence, the following order :

ORDER
(i) Both Bail Applications are allowed.
(ii) The applicants, Parag Rajendra Patil in Bail Application No.1107 of 2023 and Prashant @ Gaurav Gopal Choudhari in Bail Application No.1108 of 2023, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) each with one solvent surety in the like amount each in connection with the above crime, on the conditions that they shall not tamper with the prosecution witnesses.
(iii) The applicants shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet.
(iv) The applicants shall refain themselves from involving in a similar crime.
