DATED : 14th AUGUST, 2017 PER COURT:- Learned counsel for the applicant submits that the change in circumstance in filing the present application is only to the extent that though the applicant is recovered from tuberculosis, he is not getting nutritious diet in the jail, as prescribed by the concerned Medical Officer. Learned counsel for the applicant, on instructions, seeks leave to withdraw this application with liberty to move an application before the Sessions Court for permission to provide home made food to the applicant. The application is disposed of as withdrawn with liberty as aforesaid. The applicant is at liberty to move such an application before the Sessions Court and the learned Judge may consider the same on its own merits.
