This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 75 of 2021 registered with Dhule City Police Station, Dist. Dhule for the offences punishable under Sections 406, 409, 420 and 120-B read with Section 34 of the Indian Penal Code and under Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 and Sections 4, 5 and 6 of Prize Chits Money Circulation Scheme (Banning) Act.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

As per the prosecution case, a sum of Rs. 8 lakhs were received by the present applicant. He has been behind the bars since 25th March, 2019. On investigation, the charge-sheet has been filed. The applicant has deposited a sum of Rs.3,50,000/- with AU Small Finance Bank, Dhule. The applicant now comes around to deposit the balance amount. The Court, therefore, asked the applicant to deposit a sum of Rs.6 lakhs more and place on record the receipt indicating deposit of amount of Rs.3,50,000/-. 4.

In view of above, the application is allowed. Hence I pass the following order :-

ORDER

(I) The bail application is allowed.

(II) The applicant be released, in connection with Crime No. 75 of 2021 registered with Dhule City Police Station, Dist. Dhule for the offences punishable under Sections 406, 409, 420 and 120-B read with Section 34 of the Indian Penal Code and under Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 and Sections 4, 5 and 6 of Prize Chits Money Circulation Scheme (Banning) Act, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. 2 / 3

(III) Deposit of Rs.6 lakhs shall be a condition precedent for release on bail.

(IV) If any application/s is/are made for payment of amount, the trial Court may pay the amount ratably, on conditions to be imposed by it.

(IV) The applicant shall not tamper with the prosecution evidence.
