This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 235 of 2021 registered with Kuntur Police Station, Dist. Nanded for the offences punishable under Sections 307, 326 and 120-B of the Indian Penal Code.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

The applicant had assaulted the informant on his head with an axe. It appears that the applicant has some extra marital relationship with the wife of the informant. The informant had suffered head injury. He has 1 / 2
936-BA-1146-22.odt been discharged from hospital three days after the alleged incident. The applicant has been behind the bars for little over eight months. Co-accused have been granted bail. On investigation, charge-sheet has been filed. It will take time for commencement and conclusion of the trial. The Court is, therefore, inclined to grant the application instead of strong objection by the learned A.P.P. on the ground that applicant is the author of head injury. 4.
In view of above, the application deserves to be allowed. Hence I pass the following order :-
ORDER
(I) The bail application is allowed.
(II) The applicant be released, in connection with Crime No. 235 of 2021 registered with Kuntur Police Station, Dist. Nanded for the offences punishable under Sections 307, 326 and 120-B of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.
(III) The applicant shall not tamper with the prosecution evidence.
