Apprehending arrest in Crime No.0516 of 2025, registered at Shrirampur City Police Station, District Ahilyanagar Latur for offence under sections 115(2), 118(1), 324(4), 351(2), 352 read with Section 3(5) of Bharatiya Nyaya Sanhita, applicant has preferred instant anticipatory bail application.

Criminal Application No.2338 of 2025 is filed for permission to assist learned APP. For the reasons mentioned in the application, the same is allowed and disposed of.

Learned counsel for the applicant submitted that the applicant has been falsely implicated due to village politics. It is submitted that general allegations have been levelled regarding an assault by means of a rod and knife. However, in fact, no such occurrence took place as alleged. That, the injuries sustained by the injured were suffered due to fall from motorcycle. That, an exaggerated version of the incident has been reported with an ulterior motive. According to the learned counsel, the allegations made in the FIR do not tally with the medical certificate. She lastly submits that, in view of the nature of the allegations and the fact that the alleged articles were found lying at the spot, no recovery or discovery is to be made and therefore, custodial interrogation of the applicant is not necessary. {3} counsel submitted that the applicants are ready to abide by all the conditions imposed by this Hon'ble Court. She, therefore, urged to grant relief of anticipatory bail.

While opposing the bail application, the learned APP submitted that severe injuries were inflicted. That, the medical certificate corroborates with the contents of the FIR. Therefore, for the purpose of effective investigation, custodial interrogation of the applicant is necessary. Therefore, he prayed for rejection of the application. 5.
Heard. Perused the FIR. Four applicants, namely Lakhan Suresh Lokhande, Rahul Suresh Lokhande, Deepak Suresh Lokhande, and Deepak Suresh Lokhande (Girniwala), have approached this Court seeking anticipatory bail in connection with a crime registered against them at the instance of one Viccky Jagannath Raut. The informant reported to Shrirampur Police on 22.05.2025 that, two months prior, a minor quarrel had taken place with one Suresh Lokhande, which was subsequently resolved with the intervention of relatives. However, according to him, still, since then, Suresh and his brothers were annoyed and upset and were issuing threats. He reported that on 21.05.2025, above four persons came to him; Rahul Lokhande was carrying a knife, while Lakhan Lokhande, Deepak
{4} Lokhande, and Deepak Lokhande (Girniwala) were armed with iron rods. They assaulted the informant on his leg, knee, thigh, and waist. Rahul Lokhande inflicted a knife blow on the waist and further stated that they do not fear Court proceedings as they have ample money. 6.
The injury certificate, to which the attention of this Court was invited by the learned APP. It appears that the injured has suffered three CLW injuries on the lower back, the inner aspect of the right leg, and the leg along with blunt trauma to the right side of the chest, forearm, knee, and lower thigh. Thus, as pointed out, the informant has suffered as many as six to seven injuries. The medical certificate also records the history of assault by known persons at 10:00 p.m. on 21.05.2025. In view of such material, this Court is not inclined to grant relief. Hence, the following order:
ORDER
Anticipatory Bail Application is rejected.
