Learned counsel for the applicant original accused submits that during pendency of this criminal application respondent No.1 original complainant died. Learned counsel has placed on record a copy of death certificate to that effect.

In view of the provisions of Section 256 of Cr.P.C. the applicant may approach to the Magistrate for passing an appropriate order in tune with the provisions of Section 256 of Cr.P.C. Criminal application is accordingly disposed of with liberty to the applicant to approach the Sessions court or this court in case any adverse order is passed by the Magistrate. Rule discharged. ( V.
