At the outset, the learned counsel appearing for contesting respondent Nos.2 and 3 raises a preliminary objection with regard to maintainability of the petition on the ground that the Petitioner can file a revision proceeding before the State Government under Section 451 of the Maharashtra Municipal Corporation Act, 1949.

Considering the preliminary objection raised on behalf of the said respondents, the learned counsel for the Petitioner, on instructions, seeks permission to withdraw the writ petition, in order to avail of the alternative remedy.
