Considering the fact that the Reference Court has inter alia determined the compensation by referring to the rate given in respect of the lands from earlier Land Acquisition Reference No. 1113/2007 in respect of the lands from the same village Yedshi and there is no record to show that the decision has under gone any change, it would be appropriate to allow the applicants to withdraw 75% of the amount of compensation deposited in this Court.

The Civil Application is allowed. The applicant is allowed to withdraw 75% of the amount of compensation deposited in this Court, 50% by furnishing usual undertaking and 25% by furnishing solvent security. ( MANGESH S. PATIL, J. ) mkd 1/1
