Heard. This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0144/2022, registered at Dhule Taluka Police Station, District Dhule for the offences punishable under Sections 305, 354-D, 506 of the Indian Penal Code, Sections 3(1)(w)(ii), 3(2)(5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 12 of the Protection of Children from Sexual Offences Act.

The applicant has been arrested on 5/3/2022. About six months are over post his arrest. On investigation, the charge sheet has been filed. It will take time for commencement and conclusion of the trial. Considering the nature of the offence and the fact that the charge sheet has been filed, the Court is inclined to allow the bail application. Hence the order :-

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released on bail in connection with Crime No.0144/2022, registered at Dhule Taluka Police Station, District Dhule for the offences punishable under Sections 305, 354-D, 506 of the Indian Penal Code, Sections 3(1)(w)(ii), 3(2)(5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 12 of the Protection of Children from Sexual Offences Act on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount.

(iii) The applicant shall not tamper with the prosecution evidence.

(iv) Fees of Ms Sayali S. Tekale, Advocate for respondent No.2 (appointed) is quantified at Rs.6000/- (Rupees six thousand).
