The learned Counsel for the Applicants as well as learned APP submit that the Police/Investigating Officer, SDPO Shevgaon of Up-Vibhag Shevgaon, has filed an 'A' summary in the present crime which is pending for consideration before the Special Court. He has produced an order passed by the District and Sessions Judge, Ahmednagar, wherein it is stated that the proceeding is assigned to

2 918.ABA-1123-2025.doc the Court No. DJ-5. The said order is taken on record and marked 'X' for identification. In view of the 'A' summary which is now filed by the prosecution against the present Applicants who are the accused in present Crime No.536/2025 registered with Pathardi Police Station, Dist. Ahmednagar, the present applications for anticipatory bail, can be disposed of with certain directions. Hence the following order :

ORDER

(i) All three applications stand disposed of in view of the filing of the 'A' summary by the prosecution, as there is no apprehension of arrest as of now. However, considering the fact that another complaint is already being contemplated by the complainant. (ii) The Counsel for the complainant submits that there are several complaints which are not being entertained or investigated by the police authorities.

(iii) Reserving the complainant's right to oppose the 'A' summary by filing a protest petition before the Special Court, the applications stand disposed of.

(iv) However looking to the nature of the allegation and the 'A' summary now filed, the Applicants can be protected by giving a direction that if such further need for arrest is emerged looking to the allegation, the Investigating Officer shall issue prior to 72 hours notice to the accused persons.
