Learned A.P.P. waives notice for the respondent-State.

The applicant has been convicted by the learned Additional Sessions Judge, Hingoli vide judgment and order dated 17/06/2015 passed in Special Case No.14

2 Cr. Appln. 3803/2015 of 2014, for the offences punishable under section 8 of the Protection of Children from Sexual Offences Act and section 506 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for 3 years and to pay fine of Rs.2,000/-, in default to suffer simple imprisonment for 10 days for the offence punishable under section 8 of the Protection of Children from Sexual Offences Act and sentenced to suffer rigorous imprisonment for 6 months and to pay fine of Rs.1000/-, in default to suffer simple imprisonment for 10 days for the offence punishable under section 506 of the Indian Penal Code. 5.

Considering the short term sentence of rigorous imprisonment for 3 years awarded by the learned Additional Sessions Judge and that suspension of substantive sentences for a temporary period is also ordered by the learned Additional Sessions Judge, the substantive sentences are hereby suspended.

Learned counsel for the appellant - applicant submits that the fine amount is already deposited. Therefore, the applicant be released on bail, upon his execution of P.R. bond in the sum of Rs.30,000/-

3 Cr. Appln. 3803/2015 (Rs. Thirty Thousand) and also upon furnishing surety in the like amount.
