Perused the findings recorded by the trial Court. Prima facie, those are not in consonance with the evidence brought on record, in as much as, evidence of PW-2 has not been properly appreciated by the trial Court. In that view of the matter, the application is allowed in terms of prayer clauses `A', `B', `C' and `F' and same stands disposed of.

Appeal is admitted.

Action under Section 390 of Cr.P.C. to follow against the respondents before the trial Court.
