IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 925 ANTICIPATORY BAIL APPLICATION NO. 1177 OF 2024 Sachin Bansi Dongre Bansi Pandharinath Dongre Rahul Kisan Dongre

VERSUS

The State Of Maharashtra And Another .....

Mr K. N. Shermale, Advocate for Applicants Mrs M. L. Sangit, APP for respondents/State. .....

CORAM : ADVAIT M. SETHNA, J.

DATE : 01 AUGUST 2025 P. C. :

1.

Heard Mr Shermale, learned Advocate for the Applicants and learned APP Mrs Sangit for the Respondents/State. 2.

At the very outset, the attention of the Court is drawn to the orders dated 19 July 2024 and 26 August 2024, by which the Applicants were protected. The orders granting protection to the Applicants have continued from time to time.

3.

When the matter is listed today, Mrs Sangit, learned APP has taken written instructions from the concerned Investigating Officer. Same are taken on record and marked as Exhibit 'X' for

(2) identification. It appears from the said instructions that the Applicants i.e. accused Nos. 1 to 3 have cooperated with the investigation. Mrs Sangit, learned APP would submit that they have not breached the orders dated 19 July 2024 and 26 August 2024. There is no prima facie material against the Applicants placed on record by the prosecution after the order dated 26 August 2025. From the instructions, received by the learned APP, it appears that the Applicants have duly joined the investigation. Considering such facts, physical custody of the Applicants at this stage would not be necessary. 4.

Considering the factual matrix as noted above, in my view, the interim orders dated 19 July 2024 and 26 August 2024 deserve to be confirmed. The following order would meet the ends of justice.

ORDER

(i) In the event of arrest of the applicants in connection with C.R. No.0210 of 2024 registered with Ghargaon Police Station, Tal. Sangamner, Dist. Ahmednagar for the offences punishable under Sections 39 of Maharashtra Money-Lending (Regulation) Act, 2014, they are directed to be released on bail on furnishing PR bond in the sum of Rs. 20,000 (Rupees Twenty Thousand Only) each with one solvent surety in the like amount.

(3) (ii) The Applicants shall attend the concerned Police Station as and when called for by the Investigating Officer, until filing of Charge-Sheet. They are further directed to co-operate the investigation.

(iii) The Applicants shall furnish details of residential address and other contact details such as the mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately informed to the concerned police station. (iv) The Applicants shall not leave the jurisdiction of the Court without prior permission of the Court, until filing of the Charge-Sheet.

(v) They shall not contact and/or influence the witness/es and/or tamper with the evidence in any manner whatsoever.

5.

The Anticipatory Bail Application is allowed in the above terms.

6.

Needless to state that the observations made in this order are prima facie for adjudication of this ABA. ( ADVAIT M. SETHNA, J.) sjk
