Mr. Patil, the learned counsel for the petitioner submits that, recovery is not made against all the persons to whom wrongful amount was disbursed, though they were not entitled. Even no action is taken against the Gram Sevak and Sarpanch who had given wrong information. According to the learned counsel large scale illegalities have been committed by the persons in the office. Crime be directed to be registered against them.

Mr. Bondar, the learned advocate for respondent Nos. 3 and 5 submits that, departmental enquiry is initiated against the concern Block Development Officer. Recovery is made against three persons and in respect of five persons the State has stayed the proceedings.

The respondent No. 3/Zilla Parishad may prosecute the matter with the state against those five persons. The enquiry initiated against the Block Development Officer shall be taken to its logical end. The recovery is made against three persons. 4.
