2] Present applicant, who is arrested in Crime No.124 of 2013 registered with Murum Police Station, Tq. Omerga, Dist.Osmanabad for the offences punishable under Section 395 read with 34 of Indian Penal Code, is praying for his release on bail.

2 2-crappln3814-15.odt 3] The earlier application filed by the applicant for similar relief bearing Criminal Application No.2965 of 2014 was allowed to withdraw by this Court vide order dated 16th July, 2014 as the applicant wanted to file fresh application in the sessions court in view of filing of the charge sheet. As next of the applications of the applicant is also dismissed by the sessions court, present application is preferred by the applicant. 4] Undisputedly, the Investigating Officer has withdrawn the charges under the provisions of Maharashtra Organised Crime Control Act. However, the papers would show that present applicant has, allegedly, made recovery of the gold ornaments from his own house.

5] In the circumstances, since there is a strong prima facie case, the applicant can not be

6] Learned Sessions Judge is directed to expedite hearing of the sessions case.
