Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.40 of 2024 registered with Sonkhed Police Station, District Nanded for the offence punishable under Sections 302, 498-A, 323 r/w 34 of the Indian Penal Code.

The daughter-in-law has lost the life. Her cause of death was 'Smothering with constriction of neck, associated with evidence of head injury'. Admittedly, the incident happened in the morning. The prosecution has a evidence that when the incident happened, the applicant was not in the house. Only the father-in-law and the victim were in the house. The victim also did not state the incident to her brother when he reached to her. Considering the material on record, there is a ground to dispute the involvement of the applicant in the

939-ba-1195-2024.odt (2) crime. No weapon is used in the crime. Nothing is to be recovered from the applicant. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Godavari W/o Pundalik Mudgule, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
