ORDER

Not on board. By consent of both sides, take on board.

Parties have settled the disputes. Both the parties filed terms of compromise on record, which is marked as Exhibit 'X'
for identification.
Appellant/Claimant is present along with his Advocate. He confirms the signatures on the terms of settlement, which is duly attested by his Advocate. He accepts the same to be voluntary.

Having regard to the facts of the case, terms FA-2229-2010.odt
of settlement are reasonable and hence, deserves to be accepted. Learned Counsel for Insurer undertakes to deposit sum of Rs. 5 lacs in this Court within a period of six weeks. Learned Counsel for Appellant/Claimant seeks withdrawal of the said amount. Learned Counsel for Insurer records no objection for the same. Registry to permit withdrawal of the amount of Rs. 5 lacs by the Appellant/Claimant.

In view of above, Appeal stands disposed of.

The Court Fee Refund Certificate be issued as per the Rules.

The Civil Application/s, if any, stand disposed of.
7.
The award/decree be drawn up in terms of compromise.

No order as to costs.
