The applicant seeks bail in Crime No.81 of 2024 registered with Chalisgaon City Police Station, District Jalgaon for the offence punishable under Sections 3, 4, 25 and 29 of the Arms Act and Sections 37(1)(3) and 135 of the Maharashtra Police Act. 3.

It has been alleged against the applicant that he was the agent assisting the seller of the fire arms to the other co-accused. However, nothing has been recovered from him. There are no antecedents like this offence. Therefore, the antecedents of the crime registered against him under Section 307 of the Indian Penal Code, would not come in the way to decide his bail application. The applicant is languishing in jail for sufficient time. Nothing is to be recovered from him. Hence, he deserve bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Nikhil @ Bhola Sunil Ajbe, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
