Case of the prosecution is that accused Nos. 1 and 2 assaulted the deceased Amol Ghuge with kicks and fist blows and committed the murder. Allegations against the applicant (Accused No. 3) are that he helped accused Nos. 1 and 2 to dispose of dead body with intention to destroy the evidence.

Section 201 of the Indian Penal Code specifies the offence regarding destruction of evidence of offence. The offence is bailable. Therefore, following order is passed. ba999.21.odt
ORDER
1.
Application is allowed.
2.
Applicant be released on bail on his furnishing PR bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with one solvent surety in the like amount in connection with CR No. 0005 of 2020 under Sections 302, 201 read with Section 34 of the Indian Penal Code registered with CIDCO Police Station, District Aurangabad, on condition that he shall not tamper the prosecution evidence.
