Learned Counsel appearing for the applicant submitted that in companion appeals, this Court ( Coram: V.K.Jadhav, J.), in an order passed in C.A.No. 6477/2016, with connected matters, on 17th of June, 2016, has permitted the claimants therein to withdraw 50 per cent of the amount on furnishing undertaking; 25 per cent amount on furnishing Bank guarantee and has directed investment of remaining amount in Fixed Deposit Receipt. Learned Counsel has tendered across the Bar copy of order passed in C.A.No.6477/2016, with connected matters; the same is taken on record.

Learned A.G.P. does not dispute the correctness of the facts stated by the learned Counsel for the applicants. 3.

In view of the above, the following order is passed: agp/-

ORDER

1.

The applicants are permitted to withdraw 50 per cent of the deposited amount on furnishing undertaking, and 25 per cent of the deposited amount by furnishing Bank guarantee of any nationalized, or Scheduled Bank in the like amount, to the satisfaction of the Registrar(Judicial) of this Court. 2.

Remaining 25 per cent of the deposited amount be invested in any Nationalized Bank initially for a period of two years and, if required, till disposal of the appeal. 3.

Civil Application for withdrawal of amount stands disposed of.
