1) Heard the learned Counsel for the applicants. It is submitted that 50% amount of the award has been deposited by the acquiring body before the executing court and the same has been VSM

19 ca 8907-17 .odt withdrawn by the claimants. It is further submitted that remaining 50% amount has been deposited by the acquiring body in this Court. The withdrawal of the said amount is sought by the claimants. The learned Counsel submits that in similar matter this court has permitted the claimants to withdraw 75% amount deposited by the acquiring body. 2) In view of the above, I pass following order.

ORDER

1.

Applicants are permitted to withdraw 50% of the amount deposited by the acquiring body in this court. 2.

Balance 50% amount be invested in a Nationalized Bank, initially for two years, and if so required for further period till disposal of the appeal.

3.

Civil Applications for withdrawal of the amount stand disposed of.
