The petitioner has put forth prayer clause '

B'

as under :- "B. The writ of mandamus may be issued against Respondent Nos. 1 to 6 to pay the pension benefit i.e. the gratuity, leave encashment and difference of payment of assured promotion as early as possible within stipulated time. And also thereby deciding application dated 01.02.2021, 10.05.2021, 15.06.2021, 06.08.2021, 15.09.2021 and 30.09.2021."

The learned Advocate for the petitioner submits that respondent No.5 will have to decide all the above mentioned representations, together. The petitioner is not granted the retiral and pensionary khs/August 2022/8494

- 2 - benefits.

In view of the above, since an innocuous prayer is put forth, we are issuing notice to the Nandurbar Nagar Parishad. This petition is disposed off. Respondent No.5 would consider the representations of the petitioner set out in prayer clause '

B' and take a stand on those representations in accordance with the rules and policies applicable. We expect respondent No.5 to communicate it'

s decision to the petitioner on or before 15.12.2022.
