We have heard Mr. Patnurkar, the learned counsel for the petitioner and Mr. Thigle, the learned Additional Government Pleader for respondents.

Mr. Patunkar, the learned counsel submits that, the directions given by this Court in Writ Petition No. 10236 of 2013 dated 13.01.2014 have not been complied. No decision has been taken by respondents pursuant to the orders of this Court on the proposal of the present petitioner, as such have committed contempt.

Mr. Thigle, the learned Additional Government Pleader submits that, the respondent Nos. 2 and 3 have already taken decision. The proposal from the respondent No. 4/Education Officer was received by
2 cp 360.14 the office of the Deputy Director of Education on 29.09.2014. Upon receipt of the said proposal and after ascertaining its requisite compliance, the same is forwarded further to the Secretary, School Education and Sports Department, Mantralaya, Mumbai for appropriate decision in accordance with law and has further taken follow up action on 02.02.2015. It is for the Secretary now to take decision upon the same.

It appears that, in the writ petition the directions were given to the respondent Nos. 2 and 3 that is Director of Education and Deputy Director of Education. They have done their job and forwarded it to the respondent No. 1 and now it is for the respondent No. 1 to take the decision. In fact there were no directions against the respondent No. 1 in the writ petition. In the light of that, contempt cannot be allowed against the respondent No. 1. However, considering the directions given in writ petition, the respondent No. 1 shall take decision on the proposal which is forwarded by respondent Nos. 2 and 3 to the respondent No. 1. The respondent No. 1 shall take decision on the same in accordance with law expeditiously. The contempt petition accordingly stands disposed of. No costs.
