Mr.Shinde, learned counsel submits that though Respondents have granted compensation, the petitioners have accepted the said amount under protest. As per the National Highways Act, the provision for filing claim for enhancement is before the Arbitrator. The Respondent No.1 has not yet appointed Arbitrator.

Mr.Kulkarni, learned counsel for Respondent No.1 on instructions submits that the Arbitrator would be appointed within a period of three (3) weeks. We accept the said statement.

In view of the said statement, the Writ Petition is disposed of. No costs.
