This application is moved for extension of time for disposal of RCS No. 102/2022. Learned counsel for the applicant submits that the learned Trial Court in view of the direction passed by this Court by order dated 08/11/2023 is required to dispose of the suit within the time limit prescribed. It is his submission that for this reason prejudice is likely to be caused to the parties as the learned Trial Court is not in a position to accommodate parties. It is further claimed that the application for sending the document for handwriting expert has been rejected and said order is challenged before this Court in Writ Petition (ST) No. 1818/2024 and for want of stay to the Trial and order of time bound disposed thereof. It is his submission, on instructions, that in order to ensure that no injustice is caused to the petitioner/plaintiff, he seeks to withdraw his prayer for expeditious disposal of petition made in Writ Petition No. 14185/2024. In view of the fact that now plaintiff himself who had sought such direction, in not interested in time bound disposal of proceeding, such request is accepted. The direction issued by this Court for deciding the suit expeditiously stands recalled. 3.
