IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 946 WRIT PETITION NO. 8587 OF 2025 SHARAD LINGAPPA KYADAR
VERSUS
THE COMMISSIONER STATE OF MAHARASHTRA AND OTHERS ...
Advocate for the petitioner : Mr. S.S. Jadhavar AGP for the respondent - State : Mr. S.P. Sonpawale ...
CORAM
: MANISH PITALE & Y.G. KHOBRAGADE, JJ.
DATE : 17 JULY 2025 PER COURT :
Heard learned counsel for the petitioner.
2.
By this petition, the petitioner is seeking a writ of mandamus from this Court for protection of funds and properties of a Trust / Markandet Mandir Devasthan, Ahmednagar. Some ancillary directions are also sought.
3.
We are of the opinion that such a writ petition cannot be entertained in the light of the detailed machinery and plethora of provisions under the Maharashtra Public Trusts Act, 1950 (for short 'Act') under which the petitioner can certainly ventilate his grievance. Various provisions under the said Act, particularly Chapter VI pertaining to control of such Public trusts being in the hands of the office of the
2 WP / 8587 / 2025 Charity Commissioner, indicate that the present petition is mis-directed and that the petitioner can knock the doors of the competent authorities under the provisions of the said Act.
4.
Writ petition is dismissed.
