During the course of arguments it came to light that according to the Respondent / Gurupushyamrut Amrit Co-operative Housing Society Limited, by a resolution the membership of the Petitioner was cancelled and this was communicated to the Sub-Registrar, Co-operative Societies by a communication dated 12.10.2015. The same is placed on record at Exhibit-E.

When a query was put to the learned counsel for the Petitioner as to whether the Petitioner has sought any remedy in respect of the cancellation of his membership, she submitted that the cancellation was not communicated to him.

We are of the opinion that Exhibit-E clearly shows the stand taken by the Co-operative Society and at least now the Petitioner has knowledge about the fact of cancellation of his membership. 4.

At this stage the learned counsel for the Petitioner seeks permission to withdraw this petition with liberty to take appropriate steps with regard to cancellation of his membership. 5.

The Writ Petition is disposed of with liberty to the Petitioner to take appropriate steps, strictly in accordance with law, with regard to cancellation of his membership of the Co-operative Society. [Y.G. KHOBRAGADE, J.] [MANISH PITALE, J.] mub
