In identical matters, arising out of the same notification, this Court has permitted the applicants / original claimants therein to withdraw the amount of compensation with certain conditions.

The learned counsel for the respondent / acquiring body has also not disputed the same. In view of the above, the applicants / original claimants herein are also permitted to

withdraw the amount of compensation on the same terms and conditions. Hence, the following order :

ORDER

(i) The applicants / original claimants are permitted to withdraw 50 % amount out of the amount deposited before this Court on furnishing an undertaking to the satisfaction of the Registrar (Judicial) of this Court and 25 % amount on furnishing solvent security / surety to the satisfaction of the Registrar (Judicial) of this Court.

(ii) Civil Applications are accordingly disposed off. (V. K. JADHAV, J.) ...
