Mr. D.S. Ladda, learned Counsel for the petitioner invited our attention to the Circular dated 30.12.2016 issued by the Ministry of Finance, Department of Revenue, Central Board of Excise & Customs providing for monetary limits for filing appeals by the Department before CESTAT, High Courts and Supreme Court. He fairly points out that the tax effect in this matter is below 20,00,000/- (Rupees Twenty Lakh) and thus
(2) FA No. 1072/2006 based on the Circular issued by the Ministry of Finance, this appeal may be allowed to be withdrawn. His statement is accepted.

In view of the fact that the tax effect in this appeal is below Rs. 20,00,000/- (Rupees Twenty Lakh), First Appeal No.1072 of 2006 is dismissed as withdrawn. Refund of court fees, if any, as per Rules.

No order as to cost.
