Per Court :- By the present Petition, the petitioner is challenging the order of maintenance granted against him and in favour of Non Applicant Nos. 1 and 2 ,who are his parents.
[2] The learned counsel for Non-Applicant Nos. 1 and 2 / parents, Mr. N.B. Suryawanshi, submits that during pendnecy of present Writ Petition, both Non-Applicant Nos. 1 and 2 died. When the Writ Petition was filed in the court that time, age of Non-Applicant No.1 was 87 years and age of Non-Applicant No.2 was 75 years. Statement of Mr. N.B. Suryawanshi, learned counsel for Non-Applicant Nos. 1 and 2 is accepted. Since both Non-Applicant Nos. 1 and 2 are dead, according to Mr. S.B. Suryawanshi, learned counsel, present Writ Petition is rendered infructuous. The learned counsel for the petitioner also endorsed the same. Hence, Writ Petition is dismissed.
