I have heard learned Counsel for respective parties. It appears that the Special Land Acquisition Ofcer has passed award by forming two categories of the land. The SLAO has awarded compensation @ Rs.1340/- per Are and @ Rs.1489/- per Are for the land falling under these two categories. It further appears that the Reference Court has enhanced the compensation @ Rs.6000/- per Are for dry land and @ Rs.12000/- for irrigated land.

Learned Counsel for the applicant submits that the

{2} ca733720.odt Reference Court has enhanced the said amount on the basis of the earlier award passed by the Reference Court and the acquiring body has decided not to prefer any appeal against the earlier award.

In view of the above, the claimant herein is permitted to withdraw the compensation amount to the extent of 50% out of the amount deposited before this Court, on furnishing undertaking and 25% amount on furnishing solvent security, to the satisfaction of the Registrar (Judicial) of this Court. Civil Application is disposed of.
