This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 217 of 2020 registered with Chakur Police Station, Dist. Latur for the offences punishable under Sections 307, 324 and 504 of the Indian Penal Code.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

The F.I.R. has been lodged by mother of the applicant. It is alleged therein that the applicant assaulted her minor grand-son and granddaughter as he was not getting share in the family property. On investigation, 1 / 2

26-BA-1176-22.odt the charge-sheet has been filed. Injury certificate of the victim indicates to have suffered simple injuries. The applicant is in jail for little over two years and three months. The Court is, therefore, inclined to grant him bail. 4.

Learned counsel for the applicant has beenappointed by Legal Aid. It appears that the applicant may not be able to furnish a surety. Therefore, he shall submit the surety bond after coming out of jail. 5.

In view of above, I pass the following order :-

ORDER

(I) The bail application is allowed.

(II) The applicant be released on bail, in connection with Crime No. 217 of 2020 registered with Chakur Police Station, Dist. Latur for the offences punishable under Sections 307, 324 and 504 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety bond in the like amount.

(III) The applicant shall not enter Chakur city for six months. (IV) The applicant shall not tamper with the prosecution evidence.
