The learned counsel for the petitioner submits that the validation proceeding is pending since the year 2019. The same is not yet decided. The employer has issued notice directing the petitioner to submit the validity certificate within a period of fifteen days or else the services of the petitioner would be terminated.

The learned A.G.P. accepts notice for all respondents. 3.

To get the validation proceeding decided within the stipulated period is not in the hands of the litigant.

The petitioner shall appear before the committee on 03.09.2021.

2 47-wp 8930-2021.odt The committee shall endeavour to decide the proceeding expeditiously and preferably within a period of six (06) months from the date of appearance of the petitioner. The petitioner shall co-operate in expeditious disposal of the proceeding.

The impugned notice is quashed and set aside. 6.

The employer may not take adverse action against the petitioner only on the ground that validation proceeding is pending. 7.

The employer may take further course of action depending upon the judgment that may be delivered by the committee in the validation proceeding.
