I have heard learned counsel for the applicant for some time. Learned counsel for the applicant, on instructions, seeks leave to withdrawn this application. Learned counsel however submits that twice the directions were given to the trial court to dispose off the case expeditiously. Learned counsel submits that fresh directions may be given to the trial court since physical hearing before the trial court is now permitted.

Leave granted. The application is disposed off as withdrawn.

It appears that initially, by order dated 03.12.2019, this Court (Coram : R. G. Avchat, J.) has directed the trial court to complete the trial within a period of six months and further granted liberty to the applicant to move the court for bail in case the trial is not concluded within the said time frame. It further appears that by order dated 28.10.2020, the said time was extended by six months as requested. It appears from the observations made by the Additional Sessions Judge, Aurangabad while rejecting the application that the presence of the eye witnesses was not secured by the prosecution due to Covid-19. However, the trial is already commenced. The informant has also been examined and summons were issued to the eye witnesses. 4.
In view of the above, the trial court is now directed to dispose off the case as expeditiously as possible and preferably within a period of six months by day to day hearing, if possible. Learned Judge of the trial court shall submit fortnightly report to the Sessions Judge of the District
who shall monitor the progress of the said Sessions Case and further disposal of the said case in time-bound manner as directed by this Court.
