Having heard learned counsel for the petitioner, we find that an appeal filed by the petitioner before the Sub-Divisional Officer on the question of tenancy, which has been decided against the petitioner by the original authority, is still pending. We also find that the proceedings initiated for summary eviction of the petitioner are also pending before the Additional Collector and the matter is reserved for order on the question of maintainability. 2.

In the light of such proceedings pending before the concerned authorities it will not be appropriate to exercise writ jurisdiction in the matter. Hence, the writ petition is dismissed. 3.

The concerned authorities shall decide pending proceedings in accordance with law.
