This application is filed by original claimants in Motor Accident Claim Petition No. 94 of 2013 for withdrawal of the deposited amount of compensation in the court.

Respondent - Insurance Company opposes the application making arguments on merits.

At this stage, no opinion can be expressed regarding merits of the appeal. However, considering the award and compensation deposited in the Court, it

ca9976.18 is desirable in the interest of justice to allow the applicants to withdraw amount of Rs. Five Lac out of the deposited amount in this Court.

Applicant nos. 1 and 2 shall file written undertaking in First Appeal within 15 days from the date of passing of this order that they would redeposit the withdrawn amount as and when directed by this Court.

Civil Application is disposed of.
