The learned advocate for the Insurance Company claims that the driver was not holding valid driving licence. The amount under the Award has been deposited by nonapplicant No.1-Insurance Company.

Considering the facts, the applicant is permitted to withdraw 50 % of the amount deposited on submitting personal undertaking and balance 50% amount on furnishing bank guarantee of any Nationalized Bank. 4.

The Civil Application stands disposed of.
