Heard learned counsel for the applicants and the learned A.P.P. for respondents.

The applicants seek bail in C.R.No.0263 of 2024 registered with Rahata Police Station, Taluka Rahata, District Ahmednagar, for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 4/25 of the Arms Act.

The applicants have a case that when the police had intercepted the vehicle of co-accused, they reached on the spot. They were coming from the hospital. Since they reached on the spot where the police were patrolling, they were implicated in the crime. Earlier crime against the applicant No.1 Sameer Sandip

Learned A.P.P. has opposed the application contending that few people were standing at odd hours on the road with intention to commit robbery and dacoity. The police apprehended them. Few of them fled away. The applicants were arrested. They had masked their faces. Two sticks, iron rod and a packet of chilly powder were recovered.

Perused the papers.

Considering the offences registered against the applicants and the period of languishing in jail, no purpose would serve by keeping them behind bar. Hence the order:-

ORDER

i) The application is allowed.

ii) Applicants - Sameer Sandip Arane, Ruturaj Rahul Chavan, and Yash Pradip More, be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount each, in the above crime for the aforesaid offences, on the conditions that, (a) They shall not tamper with the prosecution witnesses. (b) They shall not indulge in the similar crime.

(c) They shall attend the Police Station as and when called on written notice by the Investigating Officer till filing of the chargesheet.
