2) The Counsel appearing for the respondents placed on record a copy of communication dated 29.6.2016 issued by the Deputy Chief Executive Officer, Zilla Parishad, Beed, where under it has been directed to Child Development Project Officer, Zilla Parishad, Beed, to implement the decision rendered by the Labour Court and issue a letter of reinstatement in favour of Indubai Babu Kasbe. The copy of the aforesaid communication is taken on record and marked `X' for identification.
3) The petitioner herein tendered an application seeking appointment in pursuance to the advertisement/proclamation issued by the Zilla Parishad for filling the vacancy, which had occurred on account of dismissal of Smt. Indubai Kasbe. It is the contention of the petitioner that although the process of selection is over, the final list has not been published.
4) Since it is noticed that the Complaint filed by Smt. Indubai Kasbe, challenging her dismissal, has been allowed and she has been directed to be reinstated in employment, the vacancy, which was advertised on account of dismissal of Smt. Indubai Kasbe, need not be filled in.
5) In view of the decision rendered by the Labour Court in the matter of Smt. Indubai Kasbe, directing her reinstatement in the employment, the instant petition is rendered infructuous and as such the same stands disposed of.
