Heard learned counsel for the petitioner.

We find that the prayer made in this Petition, is for recovery of certain amount, allegedly due to the petitioner from the respondent no. 3 - Nagar Parishad.

The claim made by the petitioner arises out of a contractual obligation and since disputed questions of facts arise in the matter, we decline to exercise writ jurisdiction under Article 226 of the Constitution of India. Hence, the Writ Petition is dismissed.

Needless to say, the petitioner would be at liberty to institute an appropriate proceeding before the competent civil Court, to seek recovery of the amount from respondent no. 3 - Nagar Parishad, in accordance with law.
