The learned counsel for the petitioner submits that the petitioner has retired from service. His gratuity amount and the other retiral benefits are withheld by the employer only on the ground that the validation proceedings are pending with the Committee since 2013.

The petitioner may make representation with regard to his grievance to the respondent-employer, which will be considered by the respondent-employer on its own merits.

The Committee shall decide the validation proceedings in respect of the tribe claim of the petitioner, expeditiously, preferably within a period of four months from the date of appearance of the petitioner. The petitioner shall appear before the Committee on 29.01.2019.
