Shri Adkine, learned Counsel, submits that total three appeals were filed out of which two are placed for hearing and present one was dismissed for default since certain compliances were not made. Learned Counsel submits that the appellants i.e. original claimants undertake not to claim any statutory benefit or interest for the period of delay of 2886 days, in the event they succeed in the present appeal and the amount of compensation is enhanced on the said amount of enhanced compensation. 2.
Having considered the submissions so made, though learned A.G.P. has opposed for condonation of delay, I am inclined to condone the delay and direct restoration of appeal to its original file. Civil Application is allowed in terms of prayer clause B & C. Present appeal as well as the connected two Appeal Nos.256/2000 and 257/2000 be placed for final disposal after four weeks. S.O. after four weeks.
