The husband of the petitioner was working with respondent No.3 School. He died in the year 2010. The petitioner submitted an application for grant of pension and other retiral benefits. It is submitted that pension is not yet sanctioned.

Learned counsel for the petitioner submits that the petitioner has submitted all the necessary documents, service book upto 2005, however, the School which has to forward the service book of the deceased husband of the petitioner is not taking any steps 3.

The learned AGP states that the School where the petitioner was working is de-recognized and no proposal is forwarded to the office of respondent Nos. 1 and 2 1/3

by the School through its Headmaster alongwith necessary documents. Respondent No.2 could gather some documents from the ex-employees, however, the service book received is updated till 2005 and not up to the year 2010. The same would also be required. Once the necessary papers are made available, the respondent No.2 would forward the same immediately to the Accountant General, Nagpur.

It appears that husband of the petitioner died on 13.09.2010 and the School where the petitioner was working stood de-recognized in the year 2011. The Society is still in existence. The society will have to take necessary steps to forward the updated service book to respondent No.2.

Though respondent no.3 is served none appears for respondent No.3.

In the light of above, we pass following order:

O R D E R

(1) Matoshri Anusayamata Shikshan Prasarak Mandal, Sahyog Nagar, Nanded shall forward service book of the deceased husband of the petitioner duly updated till the date of death of the husband of 2/3

the petitioner to respondent No.2, expeditiously, preferably within six weeks from the date of receipt of the order of this Court.

(2) The petitioner shall give copy of the order of this Court to the respondent Society. The petitioner shall also comply with other documents that would be required by respondent No.2.

(3) Upon receipt of the documents, the Education Officer shall forward the proposal to the Accountant General, Nagapur, expeditiously, preferably within three months from the date of receipt of the documents and service book.

Writ petition accordingly disposed of with aforesaid directions. No costs.
