Delay of 770 days caused in filing the appeal is sought to be condoned by the present application, as according to the learned A.G.P, conscious decision was required to be taken, as to whether the appeal should be filed.

Delay is sufficiently explained. For the reasons stated in the application, the delay is condoned and the application is allowed without any order as to costs.
