Mr. Kharosekar, the learned counsel submits that the show cause notice is issued by the Tahsildar as to why the five times penalty should not be imposed referring to Section 48(7) and 48(8) of the Maharashtra Land Revenue Code. The petitioner has filed reply, however, no decision has been taken on it. The petitioner is restrained from carrying out the work.

There is no order on record restraining the petitioner to carry out the work. As far as show cause notice is concerned it is for the Tahsildar to take decision upon it. The petitioner has already filed the reply to the said show

The Writ Petition is disposed of. No costs.
