Heard learned APP and learned counsel for the accused. 2.
Prima facie perusal of the record indicates that the evidence of the complainant to the effect of reduction of the amount from Rs.50,000/- to 35,000/- and payment of Rs.20,000/- first is duly supported by the verification panchnama. Apart from this the evidence of the complainant further indicates that on entering the chamber of the accused No.1 he by gestures has called upon the complainant to keep the bribe amount below the paper which was kept on his table. In this regard there is absolutely no cross-examination and no denial is sought by the defence of such material evidence.

seems to have not being considered by the learned Trial Court in proper perspective. Hence the case is made out by the prosecution for grant of leave to appeal. Hence appeal be registered.
